Welcome to OmnibaseCRM (“we,” “our,” or “us”). By accessing or using omnibasecrm.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
1. Description of Service
OmnibaseCRM is a unified marketing and sales software platform providing Customer Relationship Management (CRM) tools, email marketing, autoresponders, and automated lead qualification services for businesses and entrepreneurs.
2. Account Registration and Subscriptions
- Account: You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.
- Billing: OmnibaseCRM is a subscription-based service. By subscribing, you authorize us to charge your selected payment method on a recurring basis.
- Cancellations: You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing cycle.
3. Acceptable Use and Anti-Spam Policy
As a platform that provides email marketing and autoresponder capabilities, you must comply with all applicable anti-spam laws (such as CAN-SPAM, GDPR, etc.). You agree not to:
- Send unsolicited bulk email (spam).
- Import or email purchased, rented, or scraped lead lists.
- Use deceptive subject lines or false sender information.
- Use the Service for any illegal, fraudulent, or malicious activity.
We reserve the right to suspend or terminate your account immediately and without refund if we determine you are violating our anti-spam policies.
4. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of the leads and data you import into OmnibaseCRM. We do not sell or share your customer data. You are solely responsible for ensuring you have the legal right to collect and store the data of the contacts you import.
5. Limitation of Liability
To the maximum extent permitted by law, OmnibaseCRM and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. The Service is provided on an “as-is” and “as-available” basis.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes. Continued use of the Service after changes are made constitutes your acceptance of the revised Terms.
